“The arc of history bends towards justice” – Dr. Martin Luther King, Jr.
We represent clients whose civil rights have been violated. These rights are enumerated in the Amendments to the U.S. Constitution, the New York State Constitution, Civil Rights Acts and elsewhere. For example, wrongful arrest by a police officer or unreasonable search and seizure may be a violation of ones constitutionally guaranteed civil rights and the basis for a lawsuit against government agencies and/or government officials. A lawsuit against the government may serve different purposes: On the one hand, it is a tool for collecting damages and costs from the government. On the other hand, and no less important, it can lead to significant changes in government policies and behavior.
Perlmutter & McGuinness, P.C. have been very successful in pressing civil rights claims on behalf of its clients. For example, we obtained a $1,000,000 award for a client attacked by inmates on Riker’s Island by showing the prison guards were deliberately indifferent to the client’s welfare. A successful civil rights lawsuit requires a careful and thorough analysis of the facts and of the applicable law. We have the necessary experience for these particular lawsuits. Moreover, we are committed to prosecuting these cases from the very early stages through to a trial or a satisfactory settlement, and promoting positive systemic change to protect people in the future from similar office abuse and misconduct.
