Mr. Perlmutter has been in private practice in New York since 1992. His practice includes federal and state criminal defense, immigration and civil litigation. Mr. Perlmutter is previously an Assistant District Attorney in Queens County, New York where he concentrated in felony trials and appeals. His work includes federal death penalty defense, white-collar defense and extensive DWI work. He has served on the Criminal Courts and Criminal Advocacy committees of the Association of the Bar of the City of New York. Mr. Perlmutter is also member of the National Association of Criminal Defense Lawyers, the National College for DUI Defense. He also serves on the Criminal Justice Act Panels for the Unites States Courts for the Southern and Eastern Districts of New York.
In addition to his criminal defense work, he has successfully represented a major development corporation and community groups opposing the construction of a power plant on the New York City waterfront. His clients also include several internationally recognized artists and galleries. Mr. Perlmutter also represented seven people arrested for non-violent civil disobedience protesting New York City's closure of six firehouses. He helped found and serves on the board of a parks conservancy, the Open Space Alliance for North Brooklyn and Greenpoint Waterfront Association for Parks & Planning, a not-for-profit corporation prominent in New York City for urban environmental advocacy and coastal management.
Mr. Perlmutter's work has been reported in The New York Times, National Public Radio, and elsewhere. Mr. Perlmutter has also appeared on WABC7 and News Channel 4 as a commentator on criminal law issues. He also regularly appears on Lisa Bloom InSession on TrueTV (formerly Court TV). He worked as an associate for Morgan Lewis & Bockius and Lord Day & Lord, Barrett Smith in securities and complex civil litigation. Mr. Perlmutter is the recipient of the American Jurisprudence award in trial advocacy from the University of Wisconsin Law School. He received his undergraduate degree with honors from Columbia University. He is admitted to practice in New York, Connecticut, the United States District Courts for the Southern, Eastern and Northern Districts of New York, and the Eastern and Western Districts of Wisconsin, and the United States Court of Appeals for the Second Circuit. Mr. Perlmutter graduated from the University of Wisconsin Law School with honors.
Mr. Perlmutter’s notable criminal cases include serving as lead trial counsel obtaining acquittals on six murders for reputed acting Colombo Family crime boss Thomas Gioeli, including the first charged Mafia killing of a New York City police officer in over a century. He was also lead counsel in the federal death penalty trial of Folk Nation leader James McTier, which resulted in a life sentence for the murder of three innocent bystanders in three separate gang-related incidents. In addition, Mr. Perlmutter exposed large-scale NYPD ticket-fixing corruption while securing an acquittal for a former Bronx prosecutor charged with a felony drunk driving offense. He also successfully represented a high-level New York City employee who was the target a major federal environmental criminal investigation, and a world famous art dealer and gallery that was the subject of a federal tax fraud investigation.
In public interest litigation, Mr. Perlmutter recovered $1.36 million in damages and fees after a pretrial detainee suffered a broken jaw in guard-initiated gang violence on Riker’s Island. He also successfully litigated for over a decade in inter-agency environmental and utility regulatory proceedings, as well as ancillary eminent domain litigation, to halt construction of an 1100-megawatt natural gas power plant on Brooklyn’s East River. Mr. Perlmutter also acted as co-counsel recovering a substantial monetary award for over two hundred Brooklyn property owners and renters suing ExxonMobil related to damages from a 17-million gallon underground oil spill – the largest underground spill in U.S. history.
Mr. Perlmutter currently serves as the representative of Assemblyman Codes Committee Chairman Joseph Lentol on the New York Justice Task Force, a permanent body advising the Chief Judge of New York State on systemic and legislative changes to avoid wrongful convictions. He previously served on the Criminal Courts and Criminal Advocacy Committees of the New York City Bar Association.
Mr. Perlmutter is also a trustee of the Hannah Senesh Community Day School in Brooklyn, New York. He also served as a member of the working legislative group of the Governor’s Impaired Driving Task Force. Mr. Perlmutter’s work has been reported in the New York Times, the Wall Street Journal, National Public Radio, and elsewhere. Mr. Perlmutter has also appeared regularly as a legal commentator on In Session with Lisa Bloom on TrueTV (formerly Court TV) as well as on News Channel 4 and WABC 7. He also has lectured on legal developments in DWI law for the New York State Bar Association. Mr. Perlmutter worked as an associate for Morgan Lewis & Bockius and Lord Day & Lord, Barrett Smith in securities and complex civil litigation, and for the whitecollar defense firm of Newman & Schwartz.
Mr. Perlmutter received his undergraduate degree with honors from Columbia University. He also graduated from the University of Wisconsin Law School with honors where he received the American Jurisprudence Award in Trial Advocacy. He also attended the Brian Shechmeister Death Penalty College at Santa Clara University Law School and the Justice & Society Seminar at the Aspen Institute. Mr. Perlmutter is admitted to practice in the United States Supreme Court, the United States Court of Appeals for the Second Circuit, the United States District Courts for the Southern, Eastern and Northern Districts of New York, and the Eastern and Western Districts of Wisconsin, as well as in the courts of New York and Connecticut.
Mr. Perlmutter resides in Brooklyn with his wife and two sons. He is also an avid life-long sailor having competed on the national level in several one-design racing classes, as well as offshore yacht racing both nationally and internationally.
